GENERAL TERMS AND CONDITIONS OF SALE

 

I. GENERAL

1.1. These conditions of sale are concluded on the one hand by S.A AVENTURE LAND whose registered office is 1 bis, rue Chalot, 95420 Magny-en-Vexin, registered with the Pontoise Trade and Companies Register under number B 435 093 653 hereinafter referred to as PARC AVENTURE LAND and on the other hand, by any natural or legal person wishing to make a purchase via the PARC AVENTURE website called LAND  hereinafter "the buyer".

1.2. These GTC can be consulted on the website.

 

II. PURPOSE

2.1. These conditions of sale aim to define the contractual relations between PARC AVENTURE LAND and the buyer and the conditions applicable to any purchase made through the commercial site of PARC AVENTURE LAND, whether the buyer is a professional or a consumer.

2.2. The acquisition of a good or service through this site implies an unreserved acceptance by the buyer of these conditions of sale. These conditions of sale will prevail over any other general or special conditions not expressly approved by PARC AVENTURE LAND.

2.3. PARC AVENTURE LAND reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

 

III. CHARACTERISTICS OF THE GOODS AND SERVICES OFFERED

3.1. The products and services offered are those that appear in the catalogue published on the PARC AVENTURE LAND website.

3.2. These products and services are offered within the limits of available stocks.
3.3. Each product is accompanied by a description drawn up by the supplier.

 

IV. RATES AND NUMBER OF SEATS

4.1. The prices appearing in the catalogue are prices including VAT in euros taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services.

4.2. PARC AVENTURE LAND reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices shown include order processing fees.

4.3. Depending on the event, different types of rates may be offered to you.

4.4. All orders regardless of their origin are payable in euros.

4.5. No refund will be made in case of loss or theft of the ticket.

 

V. GEOGRAPHICAL AREA

The online sale of the products and services presented on the site is reserved for buyers who reside in France, the Dom-Tom or Monaco.

 

VI. ORDERS

6.1. The buyer, who wishes to buy a product or a service must obligatorily:

Fill out the identification form on which he will indicate all the contact details requested or give his customer number if he has one.

Fill in the online order form giving all the references of the products or services chosen.

Validate your order after checking it.

Make the payment under the conditions provided.

Confirm your order and payment.

6.2. The confirmation of the order entails acceptance of these conditions of sale, the acknowledgment of having perfect knowledge of them and the renunciation to avail oneself of one's own conditions of purchase or other conditions.

6.3. All the data provided and the recorded confirmation will be proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out.

6.4. The seller will communicate by e-mail confirmation of the registered order.

6.5. Orders for tourist products are subject to these GTC as well as to the park's internal regulations.

 

VII. CANCELLATION, TRANSFER AND REFUND

7.1. Tickets may not be exchanged, resold or returned.

7.2. Any ticket purchased will not give rise to a refund, even in the event that the ticket has not been used by the customer.

7.3. RIGHT OF WITHDRAWAL

The consumer has a period of fourteen days to exercise his right of withdrawal from a contract concluded at a distance, following a telephone or off-premises canvassing, without having to justify his decision or to bear any costs other than those provided for in Articles L. 221-23 to L. 221-25 of the consumer code.

 

VIII. TERMS OF PAYMENT

8.1. The price is due at the time of the order.

8.2. Payments will be made by credit card; they will be made through the secure system that uses the SSL (Secure Socket Layer) protocol in such a way that the information transmitted is encrypted by software and no third party can read it during transport on the network.

8.3. The customer's bank account will be debited from the amount of the order, as soon as the transaction is finally validated.

8.4. At the request of the buyer, he will be sent a paper invoice showing the VAT.

 

IX. DELIVERIES

9.1. After acceptance of the general conditions, the customer accepts the conditions of use of the online tickets of the PARC AVENTURE LAND.

9.2. Upon confirmation of the purchase, the customer will receive an order confirmation and/or an electronic ticket. The customer must present this ticket at the cash register, on his smartphone or on a paper print.

 

X. TICKET CONTROL

10.1. The control of the order will be carried out at the entrance of the park with an operator.

10.2. Tickets giving access to the park will be issued.

10.3. PARC AVENTURE LAND reserves the right to check the identity of the customer. The customer must therefore be in possession of an official identity document, valid and with photo: identity card, passport, driver's license or residence card.

 

XI. INTELLECTUAL PROPERTY

11.1. All elements of the PARC AVENTURE LAND website are and remain the intellectual and exclusive property of S.A AVENTURE LAND.

11.2. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or sound.

11.3. Any simple or hypertext link is strictly prohibited without the express written consent of PARC AVENTURE LAND.

 

XII. PERSONAL DATA

12.1. In accordance with the law relating to data processing, files and freedoms of 6 January 1978, personal information relating to buyers may be subject to automated processing.

12.2. PARC AVENTURE LAND reserves the right to collect information about buyers, including by using cookies, and, if it wishes, to transmit the information collected to commercial partners.

12.3. Buyers may object to the disclosure of their contact details by notifying PARC AVENTURE LAND. Similarly, users have a right of access and rectification of data concerning them, in accordance with the law of 6 January 1978.

12.4. The automated processing of information, including the management of the e-mail addresses of users of the site was the subject of a declaration to the CNIL on 08 June 2005 registered under the number 1099358.

 

XIII. ARCHIVING - PROOF

13.1. PARC AVENTURE LAND will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.

13.2. The computerized records of PARC AVENTURE LAND will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

 

XIV. DISPUTE RESOLUTION

These general conditions of sale are subject both for their interpretation and for their implementation, to French law and are the responsibility of the Pontoise Commercial Court. After having entered the customer service of the Parc Aventure Land, and in the absence of a satisfactory response within 60 days, the customer may refer the matter to the Mediator of Tourism and Travel, whose contact details are Association Médiation Tourisme et Voyage, CS 30958 – 75383 PARIS CEDEX 08 - FRANCE. Methods of referral are available on its website www.mtv.travel.
